1. Introduction
The Trail Miles Loyalty Program (“Program”) is offered by Happy Grounds Management LLC (“Company,” “we,” “us,” or “our”). By enrolling in the Program, you agree to these Terms & Conditions. Participation is free of charge but subject to these rules.
2. Eligibility and Opting-In
Enrollment is open to individuals, located anywhere in the United States, who are at least 18 years of age and provided valid and accurate personal information. By enrolling, you represent that you meet eligibility requirements. Company reserves the right to deny or terminate enrollment at its discretion. You have chosen through your volition to opt-in to the Trail Miles Program and understand that you can Opt-Out at any time.
3. Consent to use of Personal Data
You consent to the collection, use, and disclosure of your personal data by the Company, Participating Properties, and their authorized third-[arty agents and licensees. Specifically the Company will collect and use : (1) Your Name ; (2) your address ; (3) your phone number ; (4) your reservation information during various stays ; and (5) the monetary value of those reservations and other purchases.
4. Consent to Emails and Marketing
You consent to receive Marketing messages related to the Trail Miles program, and understand that you will receive such messages until the time you Opt-Out of the same.
5. Nature of Trail Miles
Trail Miles are promotional loyalty points with no cash value. They are not legal tender, gift cards, or stored value. Trail Miles cannot be redeemed for cash, transferred, bartered, or sold. Company may debit, credit, or adjust balances for any reason, including error correction, suspected fraud, or abuse. Each individual who participates in the program will be given a unique account number that acts as a digital gift card.
6. Earning Trail Miles
Trail Miles are earned based on eligible purchases at participating locations, as determined by Company. Earning rates, eligible purchases, and promotions may change at any time without notice. Trail Miles earned will be a percentage of each eligible purchase. Purchases made online via the website will immediately accrue Trail miles, while purchases made over the phone will experience a 12-14 hour delay between the transaction and the accumulation of Trail Miles. 7. Timeline for Trail Miles Accruals on Previous Transactions
Upon your enrollment in the Trail Miles Loyalty Program, you will accrue points for all qualifying purchases made within the six months prior to your enrollment date, as long as the stay coincided with the Launch Date. Launch date is defined as the date the Trails Loyalty Program came into existence. For illustrative purposes, if the launch date of the Trail Miles Loyalty Program was November 1, 2025, those reservations that ended after November 1, 2025 would earn Trail Miles, those reservations that concluded prior to this date would not accrue any Trail Miles.
8. Cancellation/ Refund of Qualifying Purchase
In the event the individual cancels or has refunded their qualifying transaction, the Trail miles accrued from said Transaction would be removed 12-14 hours after the cancellation.
9. Sharing / Assigning of Trail Miles
The Trail Miles cannot be shared with another individual nor can they be assigned to another account. Trail miles will only accrue for the individual who made the qualifying purchase and can only be redeemed by the initial customer.
10. Redemption of Trail Miles
Trail Miles may be redeemed only for qualifying reservations and point-of-sale items at participating locations. Redemption rules, availability, and eligible items may change at any time. Refunds on purchases made with Trail Miles will be issued in Trail Miles first, followed by any cash or card refund. Trail Miles may be redeemed on only one item and applied to the most expensive eligible item in the transaction. You must identify your membership in the program at the time of the transaction to redeem your Trail Miles.
11. Expiration & Forfeiture
Trail Miles may expire after 24 months of account inactivity, or sooner if the Program is terminated. Company reserves the right to suspend or cancel accounts and forfeit balances in cases of fraud, abuse, or violation of these terms. Company is not responsible for any Trail Miles that expire, are lost by you or are redeemed due to fraudulent activity.
12. Modifications & Termination
Company may change, suspend, or terminate the Program, or any part of it, at any time without notice. This includes changing earning/redemption rates, eligibility, or benefits. The Company further reserves the right to unilaterally change the Terms and Conditions of the Program, including suspending or canceling any parts of the Program in the following cases: (1) when necessary following legislative changes; (2) if the program is no longer profitable for the Company; and (3) if deemed unnecessarily burdensome for technical or commercial reasons. If Company chooses to update the Terms and Conditions, and the changes are not material to the provision of services covered by this Program we will give you notice by either posting the change or contacting you directly.
13. Opt-Out
You may choose to Opt-out of the program at any time by logging into your profile and following the process to opt-out. After Opting out of the Program, your Personal Data as collected pursuant to your previous consent will be deleted within 30 days.
14. Limitation of Liability
Company is not liable for any loss, damage, or claim related to the Program, including errors in account balances, technical issues, or discontinued benefits. Company’s decisions regarding the Program are final.
15. Taxes
Participants are responsible for any tax consequences resulting from their participation in the Program.
16. Governing Law & Disputes
These Terms & Conditions are governed by the laws of the Commonwealth of Massachusetts. Any disputes shall be resolved through binding arbitration on an individual basis, and participants waive the right to participate in class actions.
17. Acceptance of Terms
By enrolling in or using Trail Miles, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
We may modify these Terms and Conditions from time to time by posting the revised Terms and Conditions on our website. Your continued participation in the Trail Miles loyalty Program following the posting of changes to these Terms and Conditions, or to the Privacy Policy, will indicate your acceptance of the changes.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, ACCURACY, CAPABILITY, SUFFICIENCY, SUITABILITY, CAPACITY, COMPLETENESS OR AVAILABILITY.
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL THE COMPANY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE TRAIL MILES LOYALTY PROGRAM OR ANY SUCH OTHER PRODUCTS AND SERVICES, EVEN IF A COMPANY AUTHORIZED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, therefore such exclusions may not apply to you. In the event the Company is held liable for any damages related to such matters, your sole and exclusive remedy will be limited to reimbursement for services or products paid by you to the entity held liable which were not provided by such entity. You hereby waive any and all rights to bring any claim or action related to such matters in any forum beyond two (2) years after the first occurrence of the kind of act, event, condition or omission upon which the claim or action is based. If any provision(s) of these Terms are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
